Will The Supreme Court Overturn Trump's Conviction BEFORE November? I HOPE SO!!!

While the name of this newsletter is “The Opinionated Ogre,” there are many a day when my brain switches to full troll mode. Where I sit there and beg Republicans to do something so spectacularly stupid that slitting their own throats would seem rational in comparison. This is one of those days.
I am on my knees begging and pleading with the Republicans on the Supreme Court: Please, for the love of God, save Donald Trump from his totally unfair political persecution. Step in and reverse his 34 convictions. Make it so we can no longer call him a convict. A felon. A criminal. A lawbreaker. A morally bankrupt offender. A…well, you get the idea.
Wipe his record clean and overrule the verdict of 12 Americans who lawfully deliberated and chose to find Donald Trump guilty of 34 crimes. Do it in the name of the rule of law. Do it in the name of Jesus. Do it in the name of “fairness.” I don’t really care. Just do it. And do it before the election. The sooner, the better.
Republicans agree with me. I’ve lost count of how many people have been crying for the Republicans on the Supreme Court to save poor ol’ Donny the convict:

Please, dear god, let them do it. Let the Republicans on the Supreme Court step in and overturn Trump’s conviction. I want them to do it as quickly as possible with as much umbrage and self-righteousness as they can muster. I will personally drive Clarence Thomas to the airport for his next billionaire-funded vacation. I will hang as many upside-down American flags for Mrs. Alito as she wants. Just do it. Pretty please?
Now, do I actually want Trump to go free? Of course not. I want him to rot in jail for the rest of his miserable fucking life. But it would be worth it to have him go free for the destruction such a move would rain down upon the Republican Party.
Every Democrat and a whole lot of independents are already really pissed off at Trump, the Republican Party, and especially the Supreme Court. Their collective corruption and lawlessness are so over the top that even people who generally shrug their shoulders at “corrupt Washington” are getting bent out of shape.1
The crass decision to overturn Roe has infuriated tens of millions of voters. For some reason, Republicans thought this rage would dissipate within months and they could carry on destroying the country unimpeded. Instead, we are now in Year Two of the Ovarian Uprising with no signs of abatement.
I, for one, would really really like it if the Republicans on the Supreme Court were to throw more fuel on that fire. Why not turn an out-of-control forest fire into a country-sized inferno? Come on, SCOTUS! You can do it!
It would be political suicide but so was overturning Roe so it’s clear that this Court no longer necessarily understands the optics of what they’re doing. With a 6-3 majority, the Republicans are so detached from accountability, more than one of them has fully embraced the notion that they, and they alone, run the United States. I’m looking at you, Alito and Thomas.
It would be the worst abuse of judicial power in our lifetimes. And that’s saying something. Regardless of the intense media coverage and the right’s nonstop screeching, this was a normal case, carried out and concluded in a normal fashion. The case was “novel”2 in the sense that no candidate for president has ever been caught falsifying business records to conceal payments explicitly to influence an election.
The right has been blithely tossing out how simple it would be for SCOTUS to just rescue Trump from the obvious injustice blablabla but there are a few things to consider:
This is a state criminal case. The Court does not have direct jurisdiction here. There are no federal issues to consider. Trump can (and will) appeal the case to the Supreme Court eventually but they can’t just show up and say, “We’re expediating this case in the name of justice yadayadayada.”3
It’s possible they can rush this case through the appeals process. Not terribly likely as appeals generally take years and there are a lot of pending appeals in New York (and everywhere else). But Republicans seem to think this can happen. God, I hope they’re right.
It’s also possible that the Court and go full hamhanded and just declare it has the authority to rule without going through the appeals process. Who’s going to stop them? It’s also possible they won’t touch this case with a ten-foot pole. Trump can still legally become president, even as a convict, so why nuke what little credibility they have left?
Trump wants this taken care of as soon as possible because, despite the fundraising bump and the bravado, this is going to severely drag Trump down. Initial polling is already showing a drop in support with up to 10% of Republican voters pulling away from the convicted felon. That number may drop or grow in the coming months but even a 2-3% drop will be fatal to Trump.
We should all be so lucky for the Court to be so stupid and corrupt that they will grant Trump’s wish before the election. Hell, if they do it sometime in 2025 or 2026, the public backlash will still fuel a blue wave and give Democrats all the political leverage they need to expand the Court (assuming they control the White House and both chambers of Congress).
In lieu of Republicans on the Court committing such an obvious error, let’s hope that the base and their elected idiots keep talking about it. Anything to remind the voting public that Republicans know they’ve turned the Supreme Court into a blatantly corrupt institution that works on behalf of the Republican Party, not the rule of law.
As we spend the next five months constantly reminding the world that Donald Trump is a convicted felon, let’s keep our fingers crossed that the right continues to react with mindless rage and does every stupid thing imaginable. People who have been tuned out of the election so far are going to start paying attention now or in the very near future. The crazier and more extreme Republicans are, the easier it will be to remind voters of how dangerous and toxic Trump and his cult were when they had power. And how voting for normal, sane public servants will always be in their best interest.

The right has latched onto “novel” to insist the case was abnormal. They’re lying and/or stupid. Covid-19 was “novel” but that didn’t make it abnormal. It just made it new which is why no one had any immunity to it. 20 years from now, there won’t be anything novel about it. It will just be another seasonal virus. The flu was novel once, too. So was the common cold.
